If a DMV hearing has been requested within 10 days following your arrest, your license will not be automatically suspended and you can continue to drive as normal while we prepare for your DMV hearing and wait to receive the DMV's decision afterwards.
The great majority of first offense cases in Los Angeles County can be resolved with no additional jail time.
Every case is unique in that there are different factors that lead to contact with law enforcement and the events that follow. While I can never guarantee the outcome of a case, I can promise that I will review the relevant evidence to pursue any defense possible and fight for the best outcome for each client.
For most misdemeanor cases in Los Angeles County, an attorney can appear on behalf of their client if the client agrees to this arrangement. There are certain circumstances that would require a client to be present in court, such as the preference of the judge where their case is assigned, but I always do my best to give my clients as much notice as possible should they need to be in court.
For misdemeanor cases, the prosecutor's office has one year from the date of the incident to file a criminal case against you. Occasionally, the prosecutor's office has not filed by the court date the client is given following their arrest. In that situation, the client may receive a notice of correction from law enforcement or a notice of filing letter from the prosecuting agency advising them of a new court date. Our office will also do periodic checks for filing through court resources. If the case is not filed within the one year period, we will file a petition with the court to seal and destroy the records of the client's arrest. For felony matters, the same process applies, but the time in which the prosecutor's office must file charges (the statute of limitations) varies depending upon the type of crime the client is alleged to have committed.
