Not every DUI case carries the same penalties. Certain facts or allegations known as DUI enhancements can significantly increase the penalties associated with a DUI conviction or require additional sentencing conditions.

What Is a DUI Enhancement?

DUI enhancements are additional allegations or circumstances that make the punishment for a driving under the influence conviction more severe, triggering mandatory sentencing requirements. Depending on the specific facts of the case, an enhancement may increase jail time, lengthen the required DUI education program, or result in other mandatory penalties.

High Blood Alcohol Concentration Enhancements

A driver's blood alcohol concentration (BAC) directly affects sentencing severity.

  • A BAC of 0.15% or higher: This level may result in increased jail time or a longer mandatory DUI education program.
  • A BAC of 0.20% or higher: This level generally requires the completion of a nine-month DUI school instead of the standard three-month program.

Refusing a Chemical Test

Refusing a required chemical test after a lawful DUI arrest carries strict post-conviction consequences. If convicted of a chemical test refusal:

  • The driver's license may be revoked for a full year.
  • The driver is typically ineligible for a restricted license during that period.
  • Completion of a nine-month DUI education program is generally required.

Child Passenger Enhancement

Having a child under the age of 14 in the vehicle during a DUI arrest triggers severe additional allegations. This circumstance often leads to a separate child endangerment charge. Depending on the facts, this can be prosecuted alongside or independently from the DUI, potentially resulting in additional legal consequences such as mandatory parenting classes or involvement from child protective authorities.

Speed-Related Enhancements

Excessive speed during the offense also increases the penalties associated with a DUI. Driving approximately 30 miles per hour over the speed limit can result in a sentencing enhancement, and certain speed-related allegations carry mandatory jail time as part of the final sentence.

Other Possible Enhancements

Driving under the influence while your driver's license is already suspended can result in additional sentencing enhancements. These specific enhancements require courts to impose mandatory penalties that would not otherwise apply to a standard DUI.

Why DUI Enhancements Matter

DUI enhancements dramatically alter the trajectory of a case by elevating mandatory penalties or adding strenuous sentencing requirements. Because of this, a primary objective of DUI defense is to aggressively challenge these enhancements whenever appropriate so that unnecessary mandatory penalties are not imposed.

Ultimately, every DUI case depends entirely on its own unique facts, the available evidence, and the applicable state law.
